COVID-19 Designated as an Airborne Infectious Disease Under New York State’s HERO Act

COVID-19 has been designated as a highly contagious communicable disease that presents a serious risk of harm to the public health under New York State’s HERO Act.  The HERO Act requires that employers implement extensive workplace health and safety protections. Employers can follow the model plan created by the New York State Department of Labor or create their own plan as long as it conforms with the HERO Act’s guidelines.

In addition to distributing their work safety plan to all employees, employers must post it in a visible location within each worksite.
